Dear Spencer,

I wanted to express my gratitude for the recent Realtors roundtable discussion, where your openness to receiving ideas and ordinances for consideration by the City Council truly inspired me. I firmly believe that as residents, it's incumbent upon us not merely to critique existing processes but to actively contribute ideas to enhance our community.

One particular matter that has weighed on my mind for quite some time is the issue surrounding Lauren's Bay. I've long held reservations about the city's policy of placing the entire burden of community enhancement on developers. Additionally, the non-payment of real estate taxes on the property for a decade troubles me deeply. However, I've come to see that the current landowner might not have been the original developer, leading me to ponder the concept of forgiveness.

Attached herewith is a draft of an ordinance I've conceptualized. However, before officially submitting it to you, I took the initiative to speak with Mr. Jim Klausman. To my astonishment, he presented a viable solution for Lauren's Bay, one that not only resolves the tax issues but also paves the way for the development on the parcels through the RH ID program.

What baffled me further was learning that the city manager has never reached out to Mr. Klausman. Despite my numerous attempts via emails and phone calls, I have yet to receive a response from the interim city manager. It seems incredulous that someone as capable as Mr. Klausman faces similar challenges in communication with the city.

I am not Mr. Klausman's spokesperson, but I strongly urge you to reach out to him. Engage in a dialogue about the issues he encounters with the City of Topeka. There shouldn't be any impediment hindering the development of Lawrence Bay, especially if there's a viable plan on the table. It is imperative that we muster all our resources to formalize and navigate it through the bureaucratic maze of Topeka.

Moreover, the process of hiring a city manager should not pose insurmountable challenges. If our elected officials lack the qualifications to undertake such a responsibility, perhaps it's time for new appointments. It is disheartening that internal promotion seems unattainable.

I trust that you share my earnest desire to see positive change in our community. Your attention to these matters and proactive engagement would be instrumental in propelling Topeka towards progress and prosperity.

Dear Jim,

I am writing to formally document the agreement we have reached regarding the listing of your real estate in Lauren's Bay within the City of Topeka. We believe that this resolution will facilitate a smooth process for both parties involved.

Background: You, as the Seller, own certain real estate in Lauren's Bay, and we have agreed to enlist the services of realtors affiliated with the Topeka Board of Realtors for the purpose of listing all the lots. The objective is to maintain a one-to-one ratio of agents to listings.

Financial Arrangements: It has been mutually agreed that all proceeds from the sale will be allocated towards settling back taxes and any special assessments associated with the property.

Special Assessment Waiver Conditions: With respect to special assessments, we have established certain conditions under which these fees may be waived:

  1. Year One Waiver: The special assessments for the first year will be waived. This is intended to provide the new owner with the necessary time to formulate plans for construction.
  2. Building Permit Requirement: To qualify for the waiver, the new owner must obtain a valid building permit within the specified timeframe.
  3. Construction Timeline: Construction on the property must be completed within 24 months from the issuance of the building permit.

Should the new owner adhere to these conditions, all special assessments will be forgiven.

If you recall, the city amended the CIP approving a study to be completed on the Kansas Turnpike Authority's potential new interchange at 29th and California. We expect results near end of February which will help guide how this land is developed. Until this is determined we will not be able to repurpose this land for alternate uses.

Is there a reason the sewer line can't hook into the main a bit further to the south? The City of Topeka owns the land to the south. Could you look at the math?

Please explain how making the land shovel-ready is NOT economic development.

 

Please explain taking an existing merchant in Topeka and considering the new location as "JOB retention." 

 

Explain how the very deal that creates the funds for economic development does not qualify for those funds.

 

We have to change the JEDO policy, where deals of this nature automatically qualify. They create sales tax, and the tax base grows when the building is built. Plus, a new building on land that has sat vacant for only God knows when. 

 

Today we need to focus on this new water meter and commercial users.

I spoke to construction regarding the portion that the doc would like to swap for the easement, and it is doable, however not the full portion.  Please see below.

 

Mark – we recently received comments back from the city regarding our layout and were told that we need to make changes.  We originally had a 2 driveway entrance, but can only have 1.  Because of that our parking shifted.  What the doc wants, goes from the property line to the edge of our drive-thru.  We need space for parking.  After that point is what we can give up (it's about 23ft wide – blue outlined box).  Our thought is that with giving us the easement to the rear of his property, he wouldn't be able to expand/build over the sewer line.  This would give him an opportunity to add parking at least (for example).  I'm simultaneously sharing this update with our operations team as well to confirm they don't have any issues, however, please feel free to share the below image with him and see if we can still make this work.
