I left a great deal at the Macerich Company to chase the dream of providing internet sales to retailers. I stared off by investing in an Internet Service Provider or ISP. At the same tim I started building my server to do secure shopping transactions.

3500 SW Topeka Blvd - Mainline Printing parking lot. White Lakes Market

The undersigned, as Lessee, hereby offers to sub-lease to _______________________________, as Sub-Lessee, certain premises located at 3500 SW Topeka Boulevard, in the City of Topeka, County of Shawnee, State of Kansas 66611, and further described as follows:

A paved area of 30,000 SF (160’ x 160’) located at the Center of the West lot of the Mainline Printing  said premises shown both OUTLINED IN RED and SHADED IN YELLOW on Exhibit "A”, attached hereto and made a part hereof, together with uninterrupted ingress to and egress from said premises at all times, across the Mainline Printing parking lot.

The term of this lease shall begin upon execution to this lease and continue thereafter until Sub-Lessee returns leased area to Lessee.

Sub-Lessee is hereby permitted to use and occupy the premises for the purpose of an open air market and Lessor authorizes Lessee to enter into subleases with vendors as attached as Exhibit A.

Sub-Lessee covenants to maintain Leased area: Sub-Lessee acknowledges the nature of the Open Air Market business can adversely affect the Lessors day-to-day operating of the parking lot due to debris that can accumulate from Lessees patrons. Lessee covenants and agrees before closing the Market daily to have clean any and all debris left over from patrons in the lease area or other parts of the Parking.

Sub-Lessee agrees to indemnify and hold Lessor harmless from any loss, damage or injury to persons or property (except property owned or controlled by Lessor) resulting from Lessee’s use and occupancy of the premises.

Sub-Lessee, hereby assumes full responsibility & liability for all activities, items seller/vendor is selling and the area the seller/vendor is renting during the duration of hours of operation for the Topeka swap meet. 
This Seller/vendor further agrees to hold harmless Mainline printing, Inc. and McClure Real Estate, LLC, Anje Kearney and Rudy Alvarez from any and all claims that arise, out of terms of any sale this seller/vendor conducts on the premised owned/ rented from Mainline printing, Mcclure real estate, Topeka Swap meet, Rudy Alvarez and Anje Kearney.

Sub-Lessee agrees to indemnify the Topeka swap meet, Mainline Printing, Inc , McClure Real Estate, LLC, Anje Kearney and Rudy Alvarez against any and all claims, disputes , or lawsuits arising out of acts or omissions of Sub-Lessee or  any of the Sub-Lessee  products, as well as the identify and reimburse for all amounts that may be assessed against the above name individuals for damages, penalties, or any amounts owing as a result of any act, omissions, products, or activity of Sub-Lessee in and about the above named premise and individuals.

This Sub-Lessee further agrees to abide by and comply with any and all rules and regulations and hereby acknowledges the Topeka swap meets right to terminate the Sub-Lessee privileges to sell on  the above named premises, or to participate in any such sale connected with the Topeka Swap Meet, for failure to abide by any future or current rules and regulations of the Topeka Swap meet, or for any other reason that the board decides, is their sole discretion, that the seller/vendors privileges to sell should be terminated.

If Lessee shall perform all the covenants herein imposed upon it, Lessor will warrant and defend Lessee in the enjoyment and peaceful possession of the premises during the term hereof.

If Lessee shall have paid rental in advance for a time during which the premises, or any part thereof, were untenantable because of damage by fire, the elements or acts of God, the Lessor will, upon demand, return an amount of such rental proportionate to the time and extent that such premises were untenantable.

If the premises, or any part thereof, shall be appropriated for any public use by virtue of eminent domain or condemnation proceeding, Lessee shall have the right to cancel this lease upon giving written notice to Lessor, and rental shall be paid only to the time when Lessee surrenders possession of the premises.

Until Lessee is otherwise notified, rental payments for the premises shall be addressed and mailed to Lessee.

RULES & REGULATIONS

1.  Once application is approved you are able to start participating in the White Lake Market.

2.  Please arrive before the WLM starting time.  Sub-Lessee arriving after opening hours will be charged a $10 late fee.  Arriving on time or before opening times is important for the safety of our shoppers and other Sub-Lessees.

3.         No illegal items allowed, all City, state and federal laws MUST be followed with items you are selling.  The selling of illegal items during The WLM will end with the IMMEDIATE termination of any contractual agreement with Sub-Lessee.  If Sub-Lessee is terminated for illegal activities NO REFUNDS WILL BE GIVEN.

4.         Sub-Lessee can begin arriving at 8:00 am and starting time for the WLM is 10:00 am.  Please see the registration table for where your area will be.  As we grow we will try to keep folks with like items separated. End time for the WLM is 5:00 pm.  Sub-Lessee will have 2 hours to have everything packed, areas free of trash and debris and moved out of the parking lot.

5.         Any grievance with other seller/ vendors has to be brought to the registration table to be handled.  Never ever openly discuss issues or grievances with other vendors.  Creating a disturbance or conflict openly in the WLM area is cause for possible termination of the Sub-Lessee rights to continue selling at our event.

6.         Sales tax must be charged.  If you do not add it to the price that is offered you must have a sign at your table that states “sales tax is combined in the price”.  If you do not have a tax ID number it is ok.  Before each event we will have Kansas Revenue Dept tax sheets for you to turn in after your event.  At the end of each event please fill out paper work and send check/money order with tax payment to the Kansas Dept of Revenue.  The amount of tax that needs to be charged on items will be on the KDR paperwork.  Revenue agents do check on vendors and if you do not accomplish the above stated items there are possible penalties. This is your responsibility not ours.

7.         It is understood that either party shall have the right to terminate this lease at any time upon Five (5) days’ prior written notice to the other.

8. All applications are to be turned in before the event. Payments made the day of the event will include a $10.00 handling fee.  Please see Anje Kearney for payments made the day of.


9.         We recommend that every vendor has their own insurance to cover any damage that may be cause due to products or area they are leasing.  We have found Shelter insurance to be the least expensive of most insurance companies

10.  Applications and payments can be taken in the form of check/money order to Wantz at 3106 sw. 29th street across from Brookwood shopping center and beside Safari Pets.  OR payments can be sent via Paypal to anje1976@gmail.com and apps emailed or delivered day of event.  Please note that if you pay via paypal you need to inform us before day of event that you paid via paypal so we can get you on the list of vendors participating. CASH WILL NOT BE ACCEPTED EXCLUDING DAY OF EVENT.


It is understood and agreed that any notice given by any party hereto to the other under any of the provisions hereof shall be deemed to have been properly delivered when registered, certified or Regular mail and deposited in the United States mails with adequate postage affixed, FedEx or similar overnight services, fax and email to:

At the termination of the lease, Lessee shall surrender the premises to Lessor in substantially as good condition as when received, reasonable wear and tear, damage by fire, the elements and acts of God accepted.

This Sub-Lease contains the entire agreement between the parties hereto, and no representations, inducements, promises, or agreements, oral or otherwise, shall be binding upon Lessor or Lessee unless reduced to writing and signed by both parties.

This Sub-Lease and all the provisions hereof shall be binding on and inure to the benefit of the heirs, executors, administrators, successors and assigns of both parties hereto.

Sub-Lessee acceptance of this offer, evidenced by executing a copy hereof, shall constitute a lease between us, subject to all of the provisions contained herein.

 We recommend that all vendors have something similar to this outdoor canopy. Now is a great time to get them... 

Do not buy the crappy cheap ones that you put together with poles. We will recommend the accordion style frame. To keep the wind from taking it, you can use 5 gallon buckets with sand/rock in them, concrete blocks and/or anything you can tie your poles to (the canopy will come with strings just like a tent)
